1. Agreement to these Terms
These Terms of Service ("Terms") are a binding agreement between you and HVZ Game ("HVZ Game," "we," "us," or "our") governing your access to and use of hvzgame.com, our mobile applications, public organization pages, administrative tools, and related services (collectively, the "Services"). By creating an account, accessing, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
2. Eligibility and authority
You must be at least 13 years old to use the Services. If you are under the age of legal majority where you live, you may use the Services only with permission from a parent or legal guardian and any approval required by your school or organization. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. The role of HVZ Game
HVZ Game provides software and technical tools that help independent schools, clubs, and other organizations promote and operate Humans vs Zombies-style events. Unless expressly stated otherwise in a separate written agreement, HVZ Game does not organize, supervise, staff, sponsor, or control those events. Each organization is solely responsible for its event rules, participant eligibility, campus approvals, waivers, safety planning, supervision, equipment standards, communications, and compliance with applicable law.
4. Accounts and account security
You agree to provide accurate, current information and keep it updated. You are responsible for safeguarding your credentials and for activity performed through your account. You may not share staff credentials, impersonate another person, create an account for someone without authorization, or transfer an account without our permission. Notify us promptly at [email protected] if you suspect unauthorized access.
5. Organization administrators
Administrators and moderators may access participant records and use tools that affect registrations, factions, teams, scores, messages, reports, permissions, and other game data. Organizations must grant access only to authorized personnel, apply the least access needed for each role, protect participant information, and use administrative tools only for legitimate event operations. Organizations are responsible for actions taken by their staff.
6. Participant responsibilities
When participating in an event, you agree to:
- follow event rules, campus policies, moderator instructions, posted boundaries, safe zones, equipment restrictions, and applicable law;
- use the Services honestly and not falsify tags, points, locations, identities, registrations, reports, or other game activity;
- respect participants, staff, bystanders, property, and spaces not included in the game;
- stop or change your conduct when directed by event staff, campus officials, property owners, law enforcement, or emergency personnel; and
- use reasonable judgment and avoid conduct that could cause injury, damage, disruption, harassment, or alarm.
7. Safety and assumption of risk
Live-action games may involve running, physical exertion, outdoor or nighttime activity, crowds, terrain, weather, foam equipment, travel, and interaction with other people. These activities involve inherent and other risks. You are responsible for deciding whether you can safely participate, following all safety requirements, inspecting your equipment, and stopping when conditions become unsafe. To the fullest extent permitted by law, you voluntarily assume the risks associated with your participation in independently operated events.
The Services are not emergency services and are not a substitute for campus safety, emergency responders, medical care, or professional event risk management. In an emergency, contact the appropriate emergency service directly.
8. Acceptable use
You may not use the Services to:
- harass, threaten, stalk, discriminate against, exploit, or endanger another person;
- submit unlawful, deceptive, defamatory, infringing, abusive, sexually exploitative, or malicious content;
- access another account, organization, conversation, or record without authorization;
- probe, bypass, disable, or interfere with security, access controls, rate limits, or service operation;
- introduce malware, automate abusive traffic, scrape protected data, or reverse engineer the Services except where law expressly permits it;
- misrepresent your identity, authority, eligibility, game state, location, or affiliation; or
- use participant data for unrelated advertising, surveillance, profiling, or discipline without a lawful and authorized basis.
9. User content and communications
You retain ownership of content you submit. You grant HVZ Game a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, display, resize, and otherwise use that content only as needed to operate, secure, improve, and support the Services. You represent that you have the rights and permissions necessary to submit the content and grant this license.
We and authorized organization staff may review, restrict, preserve, or remove content when reasonably necessary to operate the Services, enforce these Terms or event rules, investigate reports, protect users, or comply with law. We are not obligated to monitor every message or item of content.
10. Location, notifications, and gameplay features
Certain features depend on device permissions, connectivity, or information supplied by an organization. Maps, boundaries, alerts, timers, passes, notifications, scores, and similar features may be delayed, unavailable, or inaccurate and must not be relied on as the sole source of safety-critical information. You may manage device permissions through your operating-system settings.
11. Intellectual property
The Services, including their software, interface, design, documentation, and HVZ Game branding, are owned by HVZ Game or its licensors and are protected by intellectual-property laws. Except for the limited right to use the Services under these Terms, no right or license is granted to you. Organization names, artwork, and other third-party marks remain the property of their respective owners.
12. Feedback
If you provide ideas or suggestions about the Services, you grant us permission to use them without restriction or compensation. This does not give us ownership of your other content or personal information.
13. Third-party services
The Services may depend on or link to third-party products, app stores, maps, websites, or services. Third parties control their own services and terms. HVZ Game is not responsible for third-party content, availability, security, or practices.
14. Service changes and availability
We may add, modify, suspend, or discontinue all or part of the Services. We may impose reasonable limits to protect security, reliability, users, or system capacity. We do not guarantee that the Services will be uninterrupted, error-free, or compatible with every device, network, or third-party service.
15. Suspension and termination
We may restrict, suspend, or terminate access when we reasonably believe an account or organization has violated these Terms, created safety or security risk, infringed rights, misused personal information, failed to maintain authorized access, or used the Services unlawfully. You may stop using the Services at any time and may request account deletion, subject to records we are permitted or required to retain.
16. Disclaimers
To the fullest extent permitted by law, the Services are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. HVZ Game disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or usage of trade. We do not warrant the conduct of users or organizations, the safety or outcome of an event, or the accuracy of organization-supplied content or gameplay records.
17. Limitation of liability
To the fullest extent permitted by law, HVZ Game and its operators, contributors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data, goodwill, profits, or opportunity; or claims arising from an independently operated event, participant conduct, campus action, personal injury, or property damage. Where liability cannot lawfully be excluded, it will be limited to the minimum extent permitted by law. Some jurisdictions do not allow certain exclusions, so portions of this section may not apply to you.
18. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless HVZ Game and its operators, contributors, licensors, and service providers from claims, liabilities, damages, losses, and reasonable expenses arising from your unlawful use of the Services, your content, your violation of these Terms, or your infringement of another person's rights. This obligation does not apply to the extent a claim results from HVZ Game's own unlawful conduct.
19. Resolving disputes
Before filing a claim concerning the Services, you agree to contact us at [email protected] and provide a reasonable opportunity to resolve the issue informally. If a dispute cannot be resolved, it may be brought in a court with lawful jurisdiction. Nothing in these Terms limits rights or remedies that cannot be waived under applicable law.
20. General terms
These Terms and the Privacy Policy are the entire agreement between you and HVZ Game concerning the Services unless a separate written agreement applies. If a provision is found unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a transfer of the Services. Section headings are for convenience only.
21. Changes to these Terms
We may update these Terms to reflect changes to the Services, our practices, or applicable law. We will post the revised Terms with a new effective date and provide additional notice when required. If you continue to use the Services after the effective date, the revised Terms will apply.
